Bamboo Bodies™ Trial & Monthly Subscription Agreement
This Subscription Agreement (“Agreement”) is entered into between Body401k™ Inc., a Montana corporation (“Provider”), and the individual or entity enrolling in the Bamboo Bodies™ Online Program (“Subscriber”). Bamboo Bodies™ is a proprietary wellness and movement program owned and operated by Body401k™ Inc.
By enrolling in the Bamboo Bodies™ Online Program, Subscriber acknowledges that participation is voluntary and agrees to be legally bound by all terms and conditions set forth in this Agreement.
Subscription Terms & Agreement
Bamboo Bodies™ is a recurring digital subscription program providing educational movement training, recorded classes, community access, and related wellness content (“Program Materials”).
Subscriber acknowledges that this is not a one-time purchase of content ownership, but a license-based subscription that remains active only while payments remain current.
Trial Enrollment and Conversion to Monthly Membership
Upon enrollment, Subscriber receives a fourteen (14) day trial period for the price of $7.
Unless Subscriber cancels during the trial period, Subscriber’s account will automatically convert to the Bamboo Bodies™ Monthly Membership and Subscriber expressly authorizes Provider to charge $47 per month to the payment method on file beginning on the fifteenth (15th) day after enrollment and on a recurring monthly basis thereafter.
Subscriber acknowledges that:
- The $7 trial automatically converts into a paid subscription unless canceled;
- No further notice is required for the conversion to occur;
- This constitutes express authorization for recurring billing.
Satisfaction Guarantee & Refund Rights
Subscriber may cancel during the first fourteen (14) days after the first $47 monthly charge and receive a full refund of that $47 payment.
After the fourteenth (14th) day following the first $47 charge:
- All payments become non-refundable;
- Subscriber is fully committed to the monthly membership;
- Monthly charges will continue unless canceled.
The $7 trial fee is non-refundable.
Cancellation and Termination
Subscriber may cancel the subscription at any time through account settings or by emailing [email protected].
Cancellation prevents future charges but does not entitle Subscriber to any refund for amounts already paid.
Upon cancellation:
- Subscriber’s account will be deactivated;
- All access to Program Materials, classes, recordings, and community spaces will terminate.
Medical Disclaimer and Assumption of Risk
Subscriber understands that Bamboo Bodies™ includes physical movement, neuro-based movement exercises, self-massage, and fitness activities that carry inherent risks.
Subscriber affirms that they are physically capable of participation and has consulted a physician if appropriate. Subscriber voluntarily assumes all risk of injury, illness, or harm.
Subscriber releases Body401k™ Inc., Bamboo Bodies™, all instructors, employees, and affiliates from any and all claims arising from participation.
Educational Use Only
Subscriber acknowledges that Bamboo Bodies™ does not provide medical diagnosis, treatment, therapy, or counseling. No doctor-patient or therapist-client relationship is created.
Intellectual Property and License
All Program Materials are the exclusive intellectual property of Body401k™ Inc. and are protected under copyright, trademark, and trade secret law.
Subscriber is granted a limited, non-exclusive, non-transferable license to access and use Program Materials solely for personal use while the subscription remains active.
Subscriber may not copy, record, distribute, teach, sell, share, or create derivative works. Any violation constitutes material breach and will result in immediate termination without refund and potential legal action.
Confidentiality and Community Privacy
Subscriber agrees to maintain the confidentiality of all information shared by other members and by Provider and shall not disclose, record, or distribute any Program communications.
HIPAA & Health Privacy
Subscriber acknowledges that Provider is not a covered entity under HIPAA and that no doctor-patient relationship exists.
Limitation of Liability
To the fullest extent permitted by law, Provider shall not be liable for any direct, indirect, incidental, or consequential damages arising from Subscriber’s participation.
Subscriber’s sole remedy is cancellation.
Arbitration & Governing Law
All disputes shall be resolved by binding arbitration in Missoula, Montana, under Montana law. No class or representative actions are permitted.
Acceptance
By enrolling in Bamboo Bodies™, Subscriber affirms that they have read, understood, and agreed to be legally bound by this Agreement.
